Unusual Behaviour

Adam was tipped-off of by one of the guys at MX Telecom that Esendex was being used as a PPC keyword by one of our competitors.

As per my earlier post, this is always something we've taken a dim view of:

1. Esendex is a Registered Trademark so this qualifies as "passing off"

2. Google dissapprove

3. It's bad form!

A quick search revealed that the offending party was Incentivated - in fact they were outbidding us so must really have felt that Esendex was a hot search term!

As per my earlier post, I put in my normal telephone call but was suprised by the result.

Unfortunately Jonathon, I believe he is the MD, didn't want to take my call. However he left it to one of his colleagues to tell me that he didn't think "it was much of a problem".

Now I'm no IP lawyer (although my wife is) and I'd suggest it is. Still, public record is public record and it's a suprising response from a company that we'd alway considered to be one of the leading SMS marketing agencies (not an area we operate in) that would have been abreast of this types of issue.
